Please read these Terms of Service carefully before using Card Acumen. By accessing or using the platform, you agree to be bound by these terms. If you do not agree, do not use the service.
These Terms of Service ("Terms") constitute a legally binding agreement between you and Card Acumen ("we," "our," or "us") governing your access to and use of the Card Acumen platform, website, and related services (collectively, the "Service").
By creating an account, joining our waitlist, or otherwise accessing the Service, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them and our Privacy Policy.
Card Acumen is a subscription-based platform that provides sports card market intelligence, baseball prospect scouting data, automated content generation tools, and related features designed to help collectors and investors make informed decisions in the sports card marketplace.
The Service is provided on an "as available" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where practicable.

We reserve the right to suspend or terminate accounts that contain false information or that violate these Terms.
Card Acumen offers free and paid subscription tiers. By selecting a paid plan, you authorize us to charge your payment method on a recurring basis for the applicable subscription fee.
Billing cycle: Subscriptions are billed monthly on the anniversary of your signup date. Annual plans, if offered, are billed once per year.
Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features through the end of the period you have paid for. We do not provide prorated refunds for partial billing periods.
Refunds: All sales are generally final. If you believe you were charged in error, contact us within 14 days at hello@cardacumen.com and we will review your case.
Price changes: We will provide at least 30 days' advance notice before changing subscription prices. Continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing. Founding members who join prior to our public launch will be grandfathered at their original subscription rate for as long as their subscription remains active and in good standing.
Payment processing: Payments are processed by Stripe. By providing payment information, you also agree to Stripe's terms of service.
You agree to use Card Acumen only for lawful purposes and in accordance with these Terms. You must not:
Violation of these restrictions may result in immediate account termination without refund and, where applicable, legal action.
All content, features, functionality, design, text, data compilations, logos, and software comprising the Service are owned by Card Acumen or its licensors and are protected by applicable intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. Nothing in these Terms transfers any ownership rights to you.
Content you create using the Service's content generation tools (e.g., social media posts, captions, scripts) is yours. You retain full ownership of content you create, and we make no claim to it.
If you provide feedback or suggestions about the Service, you grant us a royalty-free, perpetual license to use that feedback for any purpose without obligation to you.
Card Acumen is an informational platform. Nothing on the Service constitutes financial, investment, or legal advice. All prospect data, card market analysis, buy/sell/hold signals, and price estimates are provided for informational purposes only.
Sports card values are speculative and can decline rapidly. Past performance of any card, player, or market segment is not indicative of future results. You are solely responsible for any investment decisions you make based on information obtained through the Service.
Prospect data and scouting information are based on publicly available sources and proprietary analysis. We make no warranty as to the accuracy, completeness, or timeliness of any data on the platform. Always conduct your own research before making purchasing or selling decisions.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by applicable law, Card Acumen and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or related to your use of, or inability to use, the Service.
In no event shall our total liability to you for all claims arising out of or related to these Terms or the Service exceed the greater of (a) the total fees you paid to Card Acumen in the 12 months preceding the claim, or (b) $50 USD.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you.
You may terminate your account at any time by canceling your subscription and contacting us to request account deletion.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to the platform or other users.
Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, and governing law — will continue to apply.
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If the parties cannot resolve the dispute informally, it shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in Allegheny County, Pennsylvania.
You waive any right to participate in a class action lawsuit or class-wide arbitration against Card Acumen.
Notwithstanding the above, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.
We may revise these Terms from time to time. When we make material changes, we will notify you via email and update the "Last Updated" date at the top of this page at least 14 days before the changes take effect.
Your continued use of the Service after updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.
